近期，疫情肆虐、美国暴乱，再加上国内“五个一”的政策让不少留学生们寸步难行，左右为难。
前段时间，移民局发布一则《新冠疫情导致的身份延期/转换申请延误》的邮件/新闻，充满迷惑性的标题让很多的留学生或家长们误以为移民局放宽了身份维持或宽限期的规定。
但新移民局这则新闻的重点是：
依旧没有放宽身份维持或宽限期的规定，但移民局会酌情处理身份维持问题。
蔓藤教育请来了专业的郭律师为大家相信解读这则新闻，网上盛传的240天的身份延期到底什么样的签证才可以申请？
首先，跟同学们重点强调的一点，也就是我们最关心的240工作许可延期申请问题，该政策仅针对工作许可的自动延长情况，比如：H1B或O1签证同一个雇主申请延期！
于学生身份的CPT/OPT等工作许可不适用！
移民局新闻中提到了同一个雇主在相同劳工条件下为雇员申请延期会获得240天自动的工作许可延期。
这指的是H-1B、L-1、O-1等工作签证/身份Extension的情况，依旧需要同一个雇主提交申请后才能获得；但如果雇员被开除或雇主不愿意继续支持申请的话，那就不能获得上述自动延长的工作许可。
移民局对特殊情况也有酌情处理的政策，移民局人道主义特事特办的操作主要有：
-如果是由于雇主或申请人无法控制的特殊情况（例如由新冠疫情引起的情况），导致无法按时提交申请，则移民局可以酌情考虑受理未及时申请身份延期或身份转换的申请。
-特殊情况工作许可，见下文介绍
-错过面试或RFE回复的截止日期；或加速处理（Expedited Processing）
特殊情况工作许可：
不可预见的情况给F-1学生带来严重的经济困难，或者已经获得I-140获批但排期还没到并且面临特殊情况（Compelling Circumstances）的E-3, H-1B, H-1B1, O-1, or L-1小伙伴儿及其配偶（(c)(35)和(c)(36)类别）可以申请酌情处理的特殊情况工作许可。
加速处理（Expedited Processing）：
如果满足以下条件之一，USCIS会网开一面给以加速处理（Expedited Processing）：
没有加速处理会导致公司或个人的严重经济损失，该严重经济损失需要不是雇主或申请人造成的：
（1）在合理的时间范围内提出福利请求或加快请求；
（2）合理及时地回应任何其他证据的请求；
紧急的人道主义原因的；
急迫的美国政府利益（例如国防部或DHS的紧急案件，或其他公共安全或国家安全利益）的； 或者
更正USCIS错误的。
